Nintendo can send out cease and desist notices all they want, but the same US Copyright Laws Nintendo is envoking to make sites take down B/W material ALSO protects fan sites like Bulbapedia from reposting copyrighted material, specifically for the purpose of parody and review.
It's called "Fair Use", and here is the law in question:

Basically, as long as sites are merely reviewing Black and White or using it in works that can be legally defined as "parody" (which is why those fan-made Nintendo tshirts can be sold), or anything else that the law defines, then Nintendo can't do anything but try to trick sites into removing content.
