Bulbagarden can now confirm that Joe Merrick (a.k.a. Serebii) of Serebii.net has also received an infringement notice. While he has requested that we not publish the notice in full, we have been permitted to see the original PDF notification that was sent to him. While there are some minor differences between the two, based on Joe being in the UK rather than the US, the content and format of the notices is for all intents and purposes identical to that received by PokéBeach.

A number of people have called the validity of this email into question. One strong case against the email was made by PokéBeach forums member Ambi Pom Pom, seen in the screenshot to the right. We do note that these emails appear to have been sent on behalf of the legal council for Nintendo of America, rather than the council for The Pokémon Company International, as we would have expected. To the best of our knowledge, TPCi does employ different legal council to Nintendo of America, being represented by a firm in Texas rather than the California based firm the emails appear to have originated from.
Following further information posted in the discussion thread for this story on the Bulbagarden forums by WaterPokémonMaster, we are now confident in stating that this is not a hoax of any kind, and that these notices are legitimate. The exact reasons for these notices having been sent to these sites are as of yet still not fully understood. WaterPokémonMaster has been largely tight-lipped, and Serebii has yet to have any follow-up contact with these lawyers to our knowledge.


At this point in time, Bulbagarden is yet to receive any such letter. As such, we are as of yet unable to confirm it was sent by who it claims to be from, as opposed to being from someone maliciously targeting Pokémon fansites. In the meanwhile, we ask that Pokémon fans everywhere please remain calm and patient while we attempt to check the validity of these notices, and the exact reasons for why they were sent.
